INTRODUCTION

This policy and the schedule is a contract between ECONET INSURANCE LIMITED and the insured named under the policy schedule. Any proposal and declaration made by or on behalf of the insured shall be the basis of this contract and is deemed to be incorporated into the contract. In consideration of the prior payment of the agreed premium mentioned in the schedule of this policy we will indemnify you in terms of this Policy in respect of the insured events occurring during the period of insurance, subject to the terms, warranties, exceptions/(exclusions) and conditions under the policy, for such damage or loss up to the sum insured or liability limits as stated in the policy.

Mobile Phone and Gadget Insurance is designed to provide cover against accidental damages of a mobile phone or gadget. 

 

DEFINITION OF GENERAL TERMS 

  1. Us/we/our means the Insurer Econet Insurance Limited 

  2. You/Your/Yours/Yourself means the insured named in the policy schedule 

  3. Sum Insured or amount insured is shown on the schedule. It is the maximum amount we will pay (depending on any special condition shown in the policy) for all claims which happen because of any one incident 

  4. Endorsement means any alteration made to this policy which has been agreed by us in writing or any means of formal communication 

  5. Excess - means that part of a loss for which the insured is liable. 

  6. Accidental damage means physical damage, breakage or failure of the mobile phone or gadget due to an unforeseen and unintentional event occurring either due to handling (e.g., dropping the mobile phone or gadget or through liquid contact) or due to an external event (e.g., extreme environmental or atmospheric conditions). 

 

GENERAL CONDITIONS 

Observance of policy terms 

Our liability is conditional on the observance of the policy terms and conditions by you or any person claiming indemnity or benefit. No waiver of any terms conditions and endorsements of this policy shall be valid unless made in writing and signed by our authorized official or signatory.

Prevention of loss 

You shall take all reasonable precautions to prevent loss, damage and accidents and may effect emergency repairs to your mobile phones or gadgets after notifying us to prevent further damage. 

Deliberate or fraudulent act 

We (Econet Insurance Limited) will not be liable for loss or damage arising from deliberate or fraudulent act by you or any person acting on your behalf to obtain any benefit under this policy. 

Age of Mobile phones 

We (Econet Insurance Limited) will only cover mobile phones or gadgets which are less than 36 months old from the date of manufacture,under this policy. 

Number of years a mobile phone will be covered 

Your mobile phone insurance policy will run for a maximum of two years from the date of policy inception after which your phone will nolonger be eligible for cover. 

Verification of mobile phones 

Your mobile phone will have to be verified by Econet Insurance or Econet Insurance agents before it can be covered under the mobile phone insurance. If your mobile phone insurance premiums are skipped for any particular month, your mobile phone needs to be verified again before any further premiums can be paid. 

Taking care of Mobile phones/ Gadgets 

You must not knowingly leave your gadget or mobile phone anywhere it is likely to be lost, stolen or damaged. 

Limit of Indemnity 

The limit of indemnity for each type of phone or gadget is as stated in the schedule and shall be the maximum amount payable by the company in respect of such loss or damage, but shall not exceed the reasonable market value of the phone or gadget and its accessories at the time of such loss or damage. We will note be liable for any losses where evidence of ownership is not provided.

Maximum Number of claims/Aggregate claims Limit

The policy allows a maximum number of two claims per year. In addition, the aggregate claims paid in any single policy year must not exceed the sum insured/ the value of the mobile gadget.

Ownership & Usage

We will not be liable for any losses where evidence of ownership and usage is not provided.

Basis of Indemnity

The company may, at its own option, repair, reinstate or replace such mobile phones/ Gadgets or any part thereof and /or may pay in cash the amount of the loss or damage not exceeding the reasonable market value of such mobile phones or gadgets at the time of such loss or damage. 

Total Loss Condition

At the option of the company the device can be regarded as totally destroyed if the cost of repairs is equal to or exceeds the market value of the mobile phone immediately before damage.

Definition of Market value

The current day purchase price of secondhand/used property of equal performance and/or capacity to the property lost or damaged and of substantially similar condition. Where no similar property is available, market value shall be calculated by deducting from the current new replacement value of the nearest equivalent property, an amount representing:

  1. 5% (five percent) for the first year after the date of manufacture and
  2. 10% (ten percent) per year for each succeeding year.

Underinsurance

If the phone or gadget insured is at the time of loss or damage of greater market value than sum insured you will be considered your own insurer for the difference and shall bear a ratable proportion of the loss.

Contribution

If the phone or gadget insured is at the time of loss or damage is covered by any other insurance we will not pay more than our ratable proportion.

COVER PROVIDED

Mobile Phone and Gadget Insurance is designed to provide cover against accidental damage of a mobile phone or gadget.

INSURED EVENTS

You are insured if the loss or damage to mobile phones or gadgets is caused by any of the following:

  1. Fire lighting explosion

  2. Earthquake excluding loss or damage (other than by fire) arising directly or indirectly from mining
  3. Intentional or deliberate actions of anyone other than the insured or a member of his/her immediate family.

COVER PACKAGES

The policy has one package as specified below:

  1. Accidental damages cover

SPECIFIC INSURED EVENTS

The Accidental damages cover provides insurance cover for the following specific events:

  1. Screen Damage: Coverage for accidental cracks, shattered screens, or damage caused by impact or dropping the device.

  2. Accidental Drops: Coverage for accidental drops or falls that result in physical damage to the device, such as dents, scratches, or internal 

EXTENSIONS OF COVER

  1. Non-Political Riot and strike

    1. Subject otherwise to the terms, conditions, exclusions and warranties contained In this policy, cover is extended for losses or damage directly occasioned by or through civil commotion, labour disturbances, riot, strike.

    2. Cover is also extended to losses through the act of any lawfully established authority in controlling, preventing, suppressing or in anyother way dealing with civil commotion, labour disturbances, riot, strike.

INITIAL EXCLUSION PERIOD

A 90 day exclusion period applies to your insurance. This means that you are unable to lodge a claim within the first 90 days. In the event that you are adding a gadget and/or mobile phone to your policy or replacing an existing gadget and/or mobile phone. The exclusion period only applies to the gadget or mobile phone which is added only.

CLAIM PROCEDURES

If an event giving rise to or likely to give rise to a claim comes to your knowledge you shall as soon as possible:

  1. All claims must be reported or notified to us us in writing or visit our nearest offices during working hours as soon as posible, but in any event, within 7 days of you becoming aware of an incident. 

  2. You must complete a claim form (in full) and give to us such proofs, information and sworn declarations as we may require
  3. Report to the police all incidents of accidental loss, theft, or vandalism loss or damage caused by malicious people
  4. No admission, statement, offer, promise, payment or indemnity may be made by you without our written consent
  5. If we repudiate any claim made under this policy we will be relieved of liability unless action at law commences within 90 days of repudiation
  6. We will not be liable for claims in which you fail to provide relevant documents necessary to assist in processing the claim within a period of one month unless such a claim is the subject of a pending court case
  7. All thefts or loss of mobile phones/ gadgets must be reported to the police within 24 hours of your discovery of the incident

RECOVERY PROCESS / OBLIGATIONS

If, after the payment of a claim in terms of this policy in respect of lost or stolen property, the property (the subject matter of the claim) or any part thereof is located, the insured shall render all assistance in the identification and physical recovery of such property if called on to do so by the company, provided that the insured’s reasonable expenses in rendering such assistance shall be reimbursed by the company. Should the insured fail to render assistance in terms of this condition when called upon to do so, the insured shall immediately become liable to repay to the company all amounts paid in respect of the claim.

GENERAL EXCEPTIONS

This policy does not cover loss or damage directly or indirectly occasioned by or through or in consequence of:

  1. War, invasion, act of foreign enemy, hostilities or warlike operations (whether war be declared or not), civil war, mutiny, riot, strike, civil commotion, military or popular uprising, insurrection, rebellion, revolution, military or usurped power, martial law or state of siege or any of the events

  2. Any act which is calculated or directed to further any political aim, objective or cause or in protest against any government, or any provincial or local authority
  3. An armed conflict between regions or political or religious or ethnic or tribal faction within Zimbabwe
  4. Any act of terrorism committed by any body or person or nay group of persons or by any government
  5. Loss, damage or liability directly or indirectly caused by or arising from or in consequence of or contributed to by nuclear weapons material or by ionizing radiation or contamination by radioactivity from any nuclear fuel or from any nuclear waste from the combustion of nuclear fuel whichincludes any self-sustaining process of nuclear fission
  6. Consequential loss or damage except as specifically provided
  7. Loss or damage resulting from pressure waves caused by aircraft or other aerial devices travelling at sonic or supersonic speeds
  8. Any mobile phone that is not operated on Econet Wireless Mobile Network
  9. Loss, theft, damage or breakdown as a result of not taking care of your gadget or mobile phone
  10. Any damage or loss that occurs during the exclusion period
  11. Any loss which is covered under the warranty or guarantee provided by the manufacturer or retailer
  12. Any liability arising out of your use or ownership of the gadget or mobile phone, including any illness or injury resulting from it
  13. Losses arising out of contractual agreements for personal gain or profits unless specified on policy inception
  14. Loss as a result of cosmetic damage, scratches or loss as a result of cleaning which doesnot impact the proper performance of the insured mobile phone or gadget 
  15. Any loss that arises while the gadget or mobile phone is in the possession of anyone other than the insured or a member of his/her immediate family
  16. Any policy excesses
  17. Reconnection costs or subscription fees of any kind
  18. Any costs or expenses which are not directly associated with the insured peril which caused the claim for example the cost of replacing any personalised ringtones or graphics or downloaded material or applications software
  19. Any claim resulting from the failure of the gadget or mobile phone to correctly recognise or process any calendar date or time 
  20. Loss or damage occasioned by permanent or temporary dispossession resulting from confiscation commandeering or requisition by any lawfully constituted authority
  21. Any claim resulting from mysterious disappearance of the insured mobile device or gadget
  22. Any pre-existing damages to the mobile phone
  23. Any mobile phone that has not been verified by Econet Insurance or Econet Insurance Agents
  24. Liquid spills, submersion, or exposure to moisture that results in damage to the mobile gadget

SPECIFIC EXCLUSIONS

We will not be liable for any accidental damage(Loss) to/ where /as a result of:

  1. A manufacturing defect or gadget/mobile phone recall

  2. Repairs carried out by a repairer not authorised by the Company
  3. IMEI or serial number cannot be determined from your gadget or mobile phone
  4. Wear and tear or the gradual deterioration of performance
  5. The insured not following the manufacturer’s instructions
  6. Electrical failure, power surges, or short circuits that affect the functionality of the mobile gadget.

We will not be liable for:

  1. The first 20% of each and every loss resulting from Accidental damages

WORLDWIDE COVER

The Policy will cover the gadgets/mobile phone that you take out of the Zimbabwe for up to 45 days whilst you are abroad during any period of insurance. Any replacement or repair can only be dealt with once the insured returns to Zimbabwe.

All cessions under this Treaty shall be subject to the same terms and conditions as those binding upon the Reinsured under the original acceptances.

CANCELLATION

This policy or any section of it may be cancelled by giving 30 days notice in writing on both sides provided that the following shall apply:

  1. We/ You on exercising our right to cancellation return to you the premium paid less the customary short period or minimum premium on condition there is no prior or pending claim.

We can also cancel the policy immediately if you:

  1. Do not pay the premium or do not make a payment under any installment scheme. You will not get a refund for any installment made
  2. Make any fraudulent claim

PREMIUM PAYMENTS

  1. If paid annually
    The premium is payable before the inception or renewal date as the case maybe. We will not be obliged to accept premiums paid after such date but may do so upon such terms as we may determine.

  2. If paid on monthly basis
    It is an explicit condition that all monthly premiums are paid a month in advance. Should the regular advance payment of the monthly amount cease or be interrupted, the insurance under this policy not withstanding anything contrary contained in this policy] shall be deemed to have been cancelled on the last day of the uninterrupted period for which premium has been paid with us retaining all premiums already paid. If there is a claim during the period of insurance the outstanding installments will immediately become due and the outstanding amounts will be deducted from the amount payable on the claim.
